Option 1: Cancellation

In the event of cancellation, as a tenant, you need to inform the landlord that you wish to end the contract earlier than otherwise agreed upon in the contract.

The rental period has not yet begun

You can cancel your tenancy agreement up to one month before it is due to begin.
You then pay cancellation compensation equal to one month of net rent to the landlord.

The rental period has already begun.

Termination is only possible in two situations:

  • The early termination of your studies. You provide the landlord with proof of the ending of your studies in that case. You can request that from your college or university.
  • The death of the person responsible for paying the rent.

To avoid subsequent discussions, you are best sending the termination letter via registered mail. This way, you’re certain that the letter has been received. The notice period lasts two months. This begins on the first day of the next month.

For example:

Your contract runs from 15 September 2023 to 14 September 2024.
You decide on 12 February 2024 to change your field of study and terminate the contract via registered mail on 13 February 2024.

  • Start of termination notice period: 1 March 2024

  • End of termination notice period (and end of rent): 30 April 2024

Option 2: Transfer of rent

You’ve found someone who wants to take over the remainder of the rental period. That’s already a good start, but you need to know that transfer is not allowed without the explicit written permission of the landlord. It’s not unusual for thelandlord to propose a certain termination fee—which is fair enough, as the transfer may result in certain costs.

Option 3: Subletting

Subletting can be an attractive option for leaving your student room early, without the extra costs. But be careful! Subletting is not allowed except with the explicit written permission of your landlord. Discuss the situation with your landlord.

There are also certain risks involved:

  • You remain responsible for the payment of the rent, even if your subtenant doesn’t pay their rent.
  • You remain responsible for the damage to the room at the end of your tenancy agreement. It’s a good idea to draw up a sublet contract and agree upon a bond with your subtenant.
  • Your subtenant needs to leave the room when your contract expires.

  • The subtenant is also a student at a partner institution of Brik (VUB, EhB, Odisee, LUCA, KU Leuven Brussels campuses).
  • The subtenant declares their agreement with the house rules and regulations.
  • You close a subrental agreement of your own with the subtenant and make a full inventory of premises.
  • You inform us about the subtenant and provide their contact details.
  • The sublease runs for a period that concludes no later than your own tenancy agreement.
  • You request a rental price that is no higher than your own rent.
  • You do not put the room on any search platforms without our permission.
  • The sublease is restricted in time.
  • You remain the only point of contact for payments.
